Can I sue if i get into a car accident?
Short answer – yes.
As the old saying goes “you can sue a ham sandwich in America”
However, depending on which state you are in… your right to sue can vary. In MA you need to accrue $2,000 worth of medical bills before you can sue for pain and suffering. In CT there is no limit.
Every car accident case starts with valuing the case. A lawyer will look at the police report of your crash, your medical bills, and other evidence that shows liability.
The less that liability is in question, the more successful your case will likely be.
For example, if the guy who hit you was blowing a .2 on a breathylzer going 90mph in a school zone, liability is pretty clear.
Insurance companies routinely try to minimize the liability for their client and maximize yours. If liability is clear, insurance companies will offer you the policy limit of the driver… Which can be anywhere from $0 (because the driver didn’t have insurance) to $500,000 (or more)
If liability isn’t clear, then the insurance company may fight with you.
The worst thing that can happen is if the driver doesn’t have insurance. Then you can sue him individually but if he has no money, you’re out of luck.
You can sue him, win at trial and get a million dollar judgment. But if the driver doesn’t have a million dollars… you get nothing.
