Massachusetts Law Says Life Begins At 5 Days Old

When people ask, “When does life legally start?” the answer depends on the context. In Massachusetts probate law, it isn’t about philosophy, biology, or religion—it’s about inheritance rules.

Under Massachusetts General Laws, Part II, Title II, Chapter 190B, Article II, Section 2-108, the statute says: “An individual in gestation at a particular time is treated as living at that time if the individual lives 120 hours or more after birth.”

In plain terms, that means a baby must survive at least 120 hours, or five full days, to legally count as “living” for inheritance purposes. If a child is born alive but does not survive five days, the law treats the child as if they never legally lived when it comes to inheritance. This applies whether the child was already born at the time of someone’s death or was still in the womb.

The reason behind this rule is practical. Without it, estates could be tied up in multiple rounds of probate. Imagine a parent dies and leaves everything to their child. If that child dies only hours later, the estate would need to be transferred again, possibly to different relatives. That means two probate cases, double the paperwork, and potentially property going to people the deceased parent never intended. The five-day survivorship requirement keeps inheritance rights clear, simple, and efficient.

The rule also doesn’t slow things down, since probate already has a built-in five-day waiting period before things can move forward. For spouses, surviving past the 120 hours ensures their inheritance and tax benefits remain intact. For unborn children, it must be proven that they lived at least five days after birth for them to inherit.

So the real-world effect is this: if a parent dies and leaves everything to their child, the child must live at least five days to legally inherit. If the child lives less than that, the inheritance skips to the next eligible relative.

In short, Massachusetts probate law sets a clear line: life, for inheritance purposes, legally “starts” only if you survive five full days after being born.
